Product return policy

This Withdrawal and Returns Policy applies to products purchased through the online store www.sabiocosmetics.ro and supplements the Terms and Conditions available on the website.

1. Right of withdrawal

The consumer has the right to withdraw from the distance contract, without having to provide any reason for the decision to withdraw, within 14 calendar days, under the conditions provided by Romanian Government Emergency Ordinance No. 34/2014 on consumer rights in contracts concluded with professionals, as subsequently amended and supplemented.

For the purposes of this policy, “consumer” means any natural person or group of natural persons acting for purposes outside their trade, business, craft or professional activity, as defined by the applicable legislation.

The withdrawal period expires 14 calendar days after the day on which the consumer, or a third party indicated by the consumer other than the carrier, acquires physical possession of the products.

In the case of an order consisting of several products delivered separately, the 14-day period is calculated from the date on which the consumer, or a third party indicated by the consumer, acquires physical possession of the last product.

The exercise of the right of withdrawal is not conditional upon the existence of a defect, lack of conformity or delivery error.

2. How to exercise the right of withdrawal

In order to exercise the right of withdrawal, the consumer must inform Sabio Cosmetics of the decision to withdraw before the expiry of the 14-day withdrawal period.

The consumer may exercise the right of withdrawal through the electronic withdrawal function available on the website by accessing the option “Withdraw from the contract here” [insert direct link to the withdrawal function].

After submitting the withdrawal statement through the electronic function, the consumer will receive, without undue delay and on a durable medium, confirmation that the withdrawal statement has been received, in accordance with the law.

The consumer may also communicate the decision to withdraw by means of an unequivocal statement sent to the following email address:

or may use the model withdrawal form available on the website.

Use of the model form is not mandatory.

For the purpose of identifying the order and processing the request, the withdrawal communication must contain sufficient information to identify the consumer and the contract/order in respect of which the right of withdrawal is being exercised.

It is sufficient for the communication concerning the exercise of the right of withdrawal to be sent before the expiry of the 14-day withdrawal period.

3. Returning products after exercising the right of withdrawal

Where the right of withdrawal is exercised, the consumer must return the products to Sabio Cosmetics without undue delay and no later than 14 days from the date on which the decision to withdraw from the contract was communicated.

The deadline is met if the products are dispatched before the 14-day period has expired.

Products may be returned using a courier service selected by the consumer.

The consumer shall bear the direct costs of returning the products, except where Sabio Cosmetics has agreed to bear those costs or where the return is due to a lack of conformity attributable to Sabio Cosmetics and the return costs must be borne by the seller under the applicable legislation.

No prior approval from Sabio Cosmetics is required in order to exercise the statutory right of withdrawal.

4. Condition of returned products

The consumer is only liable for any diminished value of the products resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the products.

Products must be adequately packed in order to be protected during transport.

Where the handling of the products has exceeded what is necessary to establish their nature, characteristics and functioning and has resulted in a diminished value, Sabio Cosmetics may take such diminished value into account, in accordance with the law.

This provision is without prejudice to situations where one of the statutory exceptions to the right of withdrawal described below applies.

5. Products exempt from the right of withdrawal

In accordance with the applicable legislation, the right of withdrawal does not apply, among other cases, to the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and which have been unsealed by the consumer.

This category may include certain cosmetic and personal care products where, due to their nature, packaging and manner of use, they can no longer be resold for objective health protection or hygiene reasons once unsealed.

Accordingly, for products falling within this statutory exception, the right of withdrawal can no longer be exercised once the products have been unsealed.

The mere opening of the outer transport packaging does not, in itself, result in the loss of the right of withdrawal.

The applicability of this exception will be assessed according to the nature of the product and the specific condition in which it is returned, in compliance with the legislation in force.

The exceptions to the right of withdrawal do not limit the consumer’s rights in the case of a non-conforming, defective or incorrectly delivered product.

6. Refunds in the event of withdrawal

Where the right of withdrawal has been validly exercised, Sabio Cosmetics will refund the amounts received from the consumer for the products subject to withdrawal, in accordance with the law.

In the event of withdrawal from the entire contract, Sabio Cosmetics will also refund the initial delivery costs, up to the cost corresponding to the least expensive standard delivery method offered by Sabio Cosmetics.

Where the consumer has chosen a delivery method that is more expensive than the standard delivery method offered by Sabio Cosmetics, the additional costs resulting from that choice will not be refunded.

In the event of withdrawal in respect of only part of the products in an order, the initial delivery costs will be refunded only to the extent that, taking into account the specific circumstances of the order and the applicable delivery cost structure, those costs would have been lower if only the products retained by the consumer had originally been ordered.

The refund will be made without undue delay and, in any event, no later than 14 days from the date on which Sabio Cosmetics is informed of the consumer’s decision to withdraw from the contract.

Sabio Cosmetics may withhold the refund until it has received the returned products or until the consumer has supplied evidence that the products have been sent back, whichever occurs first.

The refund will generally be made using the same means of payment as those used by the consumer for the initial transaction, unless the consumer has expressly agreed to another method of refund, provided that such method does not incur any fees for the consumer.

For orders paid by card, the refund will generally be made using the same payment method.

For orders paid in cash or cash on delivery, the refund may be made by bank transfer to the bank account indicated by the consumer.

7. Non-conforming, defective or incorrectly delivered products

The statutory 14-day right of withdrawal is distinct from the consumer’s rights in the event of lack of conformity of the products.

If the consumer receives a product different from the one ordered, a damaged product, or considers that the product is non-conforming, the consumer is requested to contact Sabio Cosmetics at:

In order to enable the matter to be handled as quickly as possible, the consumer may provide the order number, the name of the product and, where relevant, photographs or other information allowing the matter to be assessed.

Complaints concerning the quality or conformity of products will be assessed in accordance with the applicable legislation and the relevant internal verification procedures.

The fact that the existence of a lack of conformity is not confirmed following verification does not affect the consumer’s separate right to exercise the statutory right of withdrawal within the applicable period, provided that the conditions for exercising that right are met and none of the statutory exceptions applies.

The consumer’s rights in the event of lack of conformity are not limited to the 14-day period applicable to the right of withdrawal and shall be exercised in accordance with the applicable legislation governing the sale of goods.
